1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Recallify service ("Service"). By subscribing to, accessing, or using the Service, you ("Client") agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service. If entering on behalf of a clinic, you represent you have authority to bind that entity.
2. Description of Service
Recallify provides an automated patient communication system for dental and medical clinics, including:
- Missed Call SMS (Starter + Complete): Automated SMS response to missed calls, sent within approximately 30 seconds.
- Appointment Reminder System (Complete only): Day-before SMS reminders, confirmation handling, and daily summary email.
- Setup and onboarding: System configured and tested within one (1) business day of receiving required credentials.
The Service relies on third-party platforms including Twilio, Google Workspace, and n8n Cloud. Availability is subject to these providers' uptime commitments.
3. Tarification et paiement
Current pricing is as follows:

- The setup fee is due before onboarding begins and is non-refundable after the system has been configured and tested.
- Monthly fees are billed on the same calendar day each month, starting 30 days after setup completion.
- All prices are in CAD. Applicable taxes (GST/HST/QST) will be added where required by law.
- Overage SMS beyond the monthly allowance will be billed at $0.05 CAD per message, monthly in arrears.
- Payments more than 10 days past due may result in service suspension.
4. Money-Back Guarantee
We offer a 30-day money-back guarantee on monthly subscription fees only. If unsatisfied within the first 30 days, contact hello@getrecallify.com for a full refund of your first monthly payment.
The one-time setup fee is non-refundable once setup is complete, as it covers the labour of configuring, testing, and deploying your custom system.
5. Politique d'annulation
- Either party may cancel with 30 days' written notice via email to hello@getrecallify.com.
- You will retain access through the end of the current billing period.
- No partial refunds are issued for unused days in a billing period.
- Upon cancellation, workflows will be deactivated and clinic data deleted within 30 days per our Privacy Policy.
- We reserve the right to terminate immediately for material breach, including non-payment, misuse, or violation of applicable law.
6. Utilisation acceptable
You agree to use the Service only for lawful patient communication on behalf of your own registered clinic. You must not:
- Send unsolicited or spam messages to individuals who have not contacted your clinic.
- Transmit any PHI or sensitive medical data through the SMS channel.
- Resell, sublicense, or share your Recallify configuration with another clinic or third party.
- Attempt to reverse-engineer or copy the underlying automation workflows.
- Use the Service in violation of CASL or applicable telecommunications regulations.
Violation of this section may result in immediate suspension or termination without refund.
7. Responsabilités du client
You are responsible for:
- Providing accurate clinic information, phone numbers, and credentials during setup.
- Ensuring your Twilio phone number is properly configured and in good standing.
- Maintaining your Google account (Complete plan) and appointment spreadsheet accessibility.
- Notifying us promptly of any changes to your clinic phone number or operating hours.
- Compliance with all applicable laws governing patient communication and data handling in your province.
8. Disponibilité du service et SLA
We target 99% monthly uptime. However, uptime depends on third-party services (Twilio, Google, n8n Cloud) and we cannot guarantee uninterrupted service.
- Planned maintenance will be communicated at least 24 hours in advance.
- We will make commercially reasonable efforts to resolve interruptions within 4 business hours.
- Service credits for SLA breaches may be requested by contacting us.
9. Limitation de responsabilité
To the maximum extent permitted by applicable Canadian law:
- Recallify's total liability shall not exceed total fees paid in the three (3) months preceding the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages, including lost revenue or business interruption.
- We are not liable for failures caused by third-party providers, force majeure, or your failure to provide accurate setup information.
10. Propriété intellectuelle
All workflows, system designs, templates, and service infrastructure remain Recallify's exclusive intellectual property. Your subscription grants a limited, non-exclusive, non-transferable licence to use the Service during the subscription term.
You retain ownership of your own clinic data that flows through the Service.
11. Confidentialité
Both parties agree to maintain confidentiality of proprietary or sensitive information shared during the engagement. This obligation survives termination.
12. Loi applicable et litiges
These Terms are governed by the laws of Canada. Disputes will first be negotiated in good faith. If unresolved after 30 days, disputes shall be submitted to binding arbitration under the applicable Canadian Arbitration Association rules.
13. Modifications de ces conditions
We will notify active clients of material changes via email at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
